Middle District Court of North Carolina Enjoins ‘Student Unlawful Presence’ Memo

On May 3, 2019, the District Court for the Middle District of North Carolina enjoined implementation by USCIS in ALL applications of the “Student Unlawful Presence” memorandum that was issued by USCIS on August 9, 2018.  The August memorandum, formally titled “Accrual of Unlawful Presence and F, J, and M Nonimmigrants,” applied draconian policies resulting in far-reaching and devastating consequences for many foreign students and universities in the United States.
