USCIS Resumes Premium Processing for all H-1B Petitions

As of March 12, 2019, USCIS has reinstated premium processing for all H-1B petitions.  After suspending premium processing for H-1B cap cases filed April 1, 2018 and then for the vast majority of all H-1B cases in September 2018, USCIS has gradually re-expanded the categories of H-1B petitions that are eligible for premium processing until fully reinstating premium processing for all H-1B petitions on March 12, 2019.

Currently-pending H-1B petitions can now be “upgraded” to premium processing by filing Form I-907 and paying the premium processing fee of $1,410.  USCIS must take adjudicative action on a premium processing case within 15 calendar days of receiving the premium processing request.

February 15, 2019:  USCIS announced that it will resume premium processing on Tuesday, February 19, 2019 for all H-1B petitions filed on or before December 21, 2018.

January 28, 2019:  USCIS resumed premium processing for H-1B Fiscal Year 2019 cap-subject petitions (filed in April 2018).

September 2018:  USCIS suspended premium processing for most H-1B petitions.
